ABSTRACT

The statement of corporate governance must set out a description of the provider’s corporate governance arrangements and a statement of the responsibilities of the governing body. Higher education (HE) has a history of developing its own guidance on governance to pre-empt government interference. An Organisation for Economic Co-operation and Development study in 2010 considered 12 different sets of higher education governance codes and guidance across a range of countries. Such governance codes and guidance notes are popular because they are flexible instruments that rely on sector mechanisms and expertise for their development, implementation, enforcement and subsequent evolution. For instance, the Scottish HE governance Code reflects Scottish legislation which requires Chairs of governing bodies to be elected by a broad constituency including staff and students. The Office for Students as that regulator is charged with enforcing minimum standards, supporting new entrants to the market, and with a primary focus on the needs and support of students.
