ABSTRACT

This chapter provides information on the medication to be commenced. The consent was sought by medical professionals who had total control of her life within the institution, including deprivation of liberty authorised by the Mental Treatment Act 1945. The chapter presents Fiona Anderson's story. Fiona's consent to the participation for training video under coercion for example, should not be regarded as genuine and meaningful in the eyes of the law. Fiona mentioned that in the public health system in Ireland, there is only one psychiatrist per region, so it is very difficult for service users to express any dissent to their psychiatrists. Even though some of Fiona's treatment occurred prior to 2008, the functional assessment of mental capacity had been developed in English case law and could potentially have applied to Fiona. Her story reflects a typical scenario where consent was sought under domination.
