ABSTRACT

In the area of elections, Kenya has clearly begun to genuinely recognise everyone's legal capacity, as the African Commission on Human and Peoples Rights were ahead of other regional bodies in addressing the exclusion of persons who were seen to be of 'unsound mind' from voting. In 2008, Kenya ratified the Convention on the Rights of Persons with Disabilities (CRPD). Under Article 2(6) of the Constitution of Kenya, "any treaty or convention ratified by Kenya shall form part of the law of Kenya." Article 17 of the CRPD declares the integrity of a person should be protected. In Kenya, the government has made moves towards financial support for persons with disabilities through the likes of the National Development Fund for persons who may require supports such as physical equipment. Section 18 of the Kenyan Persons with Disability Act 2003, states that those with disabilities will receive formal education and be supported to complete exams.
