ABSTRACT

According to a recent Eurobarometer survey, 46 per cent of the population in Lithuania trust the media, which is higher than the European Union average. A number of provisions in the Constitution of Lithuania of 1992 are relevant for the protection of freedom of speech or expression. This chapter focuses on how new media should be treated and a number of initiatives in this area can be seen as examples of good practice. The core of the media law in Lithuania is regulated by the Law on Provision of Information to the Public. In the context of online media, legal liability in Lithuania for transgressing the limits of freedom of expression comprises civil, administrative and criminal liability. As regards the scope of obligations of intermediary providers of information society services, the Law on Information Society Services imposes the same obligation to remove impermissible comments upon notification on all providers of information society services, including intermediaries.
