ABSTRACT

SFOR took over from IFOR at the end of 1996. Like IFOR, SFOR was mandated to implement the military aspects of the Dayton Peace Agreement under Chapter VII of the UN Charter in accordance with UNSC 1088 (1996). This included permission to detain indicted war criminals though the actual powers vested in SFOR concerning this were debatable. When SFOR was deployed, the ICTY was in the middle of trying the first war criminals Tadic and Erdemovic whom the ICTY had managed to secure transfer of (President of the ICTY 1997). However, the ICTY was still struggling to secure the transfer of numerous other individuals indicted by the Prosecutor. During the eight years of operation SFOR managed to successfully detain twenty-eight indicted war criminals. In addition, three more, Simo Drljaca, Dragan Gagovic and Janko Janjic died during the operations to apprehend them. These thirty-one individuals constitute about 20 per cent of those indicted by the ICTY.
