ABSTRACT

As the legal landscape continues to shape and define access for students to appropriate sexuality education programs, further developments are sure to explore topics focused on the inclusion of sexual identity, a provision of medically accurate information, and equal access. Challengers to abstinence-only sex education programs could argue that, since such programs are public health interventions designed to exclude gay and lesbian students, they do not meet a rational basis standard of review. A battle between Planned Parenthood and the Trump administration has been unfolding in the federal courts. The suit, brought by Planned Parenthood, challenges the withdrawing of funds for family planning services which include education programs. While the focus in the media has created this to be a court battle over abortion, education programs and other health services are actually the entities losing money as federal dollars are not spent on abortion procedures specifically.
