The surveyor as expert witness
If you read the law reports covering those cases in which an issue of valuation was in dispute, and where expert surveyors have given evidence for both sides, you will frequently encounter a curious paradox. In the judgment it will be stated that any reasonably competent surveyor could arrive at a valuation within a band, or range, of value on either side of what may be regarded as the ‘correct’ valuation. The courts allow for the fact that there will be differences of opinion at any given time between surveyors as to what a particular property is worth. The fact that different surveyors place a different value on a property would not, of itself, suggest that either of them was negligent in arriving at that opinion.
