ABSTRACT

In the event that the client intends to use a bespoke form of contract, then the architect should compare the payment terms in the client’s proposed contract with the payment provisions in the Act. If the proposed contract is not compliant with the Act then it will be necessary to consider which payment provisions in the Scheme will be incorporated into the client’s contract and advise the client of the effect the Scheme will have on the proposed contract. Even if the client is not prepared to alter its contract the architect must be aware of the effect the Act and the Scheme will have on the manner in which the contract is administered.
