Care is needed to ensure that each of the different formalities are understood and complied with in an organisation. It can also be essential to preserve potentially important evidence for a number of reasons. It is likely to be needed for the organisation’s own investigation of an accident and to avoid its recurrence (see Chapter 9). Contemporaneous evidence can also be influential in determining liability in any subsequent legal proceedings. Perhaps most pressingly, there can be criminal penalties for not reporting and retaining records of accidents.
