ABSTRACT

Schedule 2 of the Agricultural Holdings Act 1986 sets out the matters which an arbitrator must take into account in assessing the rent payable in respect of a holding.

The statement of case should therefore be drafted in line with the matters which the arbitrator has to take into account. Prior to the passing of the Agricultural Holdings Act 1986 the tendency among many valuers was to deliver rather brief and sketchy statements of case. This is an unwise course to adopt and it is advisable that a great deal of detail should be included in statements of case.
