Reaching agreement to mediate 3 .01 The fi rst step in the mediation process is reaching agreement between the disputing parties to attempt to settle the dispute by mediation. This in itself can take time and require persuasive negotiation, in particular where there are several parties to the dispute. The parties frequently have different views on the merits of mediation, and also on the optimum stage of the dispute for conducting a mediation.
