ABSTRACT

From a regulatory perspective, it is the responsibility of the generator to determine whether a particular material is to be considered either a hazardous or toxic waste. Whether waste or material is considered hazardous depends on the nature and concentration of the toxic constituents contained within the waste material, their mobility and persistence in the environment, the quantities of the waste generated, and the potential for mismanagement. It is difficult to truly determine exactly what a waste is. A generator can be any person or facility who, by ownership, management, or control, is responsible for the creation of hazardous waste. The generator of any material potentially considered a waste or hazardous waste maintains several important responsibilities. The generator must first determine whether a particular waste is excluded from regulation. Should the waste not be excluded via any means, then the generator is responsible for hazardous waste determination and identification.
