ABSTRACT

People with dementia belong to one of the most vulnerable groups of society. As such, their rights need to be particularly respected and reinforced in situations where their condition has deteriorated and where they may no longer be able to understand or take decisions affecting their daily lives. Respect for fundamental human rights, such as the right to self-determination, the freedom of the individual and the integrity of the human body, remains paramount and must dictate any approach to finding pragmatic legal solutions to the problems faced by people with dementia.
