ABSTRACT
The role of custom is basic to an understanding of the development of the common law; it also lies, paradoxically perhaps, at the heart of the problematics in according recognition to the customary practices of tribal communities that came into contact with the representative authorities of the common law in the furthest reaches of the British Empire.
