The case involved six men who had been diagnosed with cancer. They were due to receive chemotherapy and it was recommended that they provide samples of sperm because the treatment was likely to render them infertile. The sperm was frozen and stored by the hospital, but due to an error it was not kept at the correct temperature. The sperm therefore became useless. The men suffered psychological harm as a result.
