ABSTRACT
Every surgeon’s heart misses a beat when they read the solicitors letter that a patient intends to sue them. Their thoughts begin to race. First, is it justified? Is it correct that they are guilty of some mismanagement, or has the patient misunderstood the situation? And secondly, why has this particular patient decided to sue? Perhaps the surgeon remembers that this complication has occurred before and it did not result in alleged negligence.
