ABSTRACT

Insurance is a highly specialised field which must be left to the experts. It cannot be stressed too strongly that architects and quantity surveyors are not insurance experts and they should always advise their clients to seek expert advice on the insurance provisions and their implications before a contract is executed. However, it is essential that the employer and the contractor have a working knowledge of their respective rights and obligations under the contractual provisions. SBC and DB deal with indemnities and insurance in clause 6 and schedule 3. IC/ICD deals with them in clause 6 and schedule 1 and MW/MWD deals with them in clause 5 in each case. They can be broken down into the following parts:

indemnities-injury to persons and property; insurance-injury to persons and property; insurance-liability of the employer (not MW or MWD); insurance of the Works-new Works-existing structures; remedies if a party fails to insure; professional indemnity insurance.
