ABSTRACT

The length of the time available in which an action can be brought varies. It depends on whether it is an action in contract or tort.

2.1 WHEN DOES TIME START TO RUN?

Q. When does time start to run against me in contract? In an action for breach of contract time, or more precisely, the limitation period, then time starts to run at the date on which the contract was broken. The limitation period is either:

1. 6 years for breach of a simple contract made either orally or in writing, or 2. 12 years if the contract is under seal.
