ABSTRACT

This chapter deals with the latest edition of the JCT Intermediate Form of Building Contract for works of simple content 1998 Edition incorporating Amendments 1 and 2 hereinafter referred to as JCT 98 IFC. The contract is, however, silent as to what should happen in the event that the Contractor exercises the right. It would appear likely that the Architect, faced with an objection from the Contractor say on the grounds that the named person could not comply with the Contractor's programme, would be obliged to issue a further instruction naming an alternative person. The precise allocation of risk is dependent both upon the option pursued and upon the means by which the named person was appointed. Where attachments to the Price Statement are not accepted direct loss and/or expense and revisions to the Completion Date are to be dealt with as provided for elsewhere in the Contract.
