The three further development agreements described in this chapter complete the clutch of principal development agreements into which a developer may usually enter and which, in turn, may shape the developer’s ultimate relationship with his construction team. It follows that only if the developer is wholly resourced, and can afford to speculate on the financial success of the development, can his contractual relations with the contractor and professional team be free of outside influence. Even then, a prudent developer must anticipate the possibility of introduction of outside contractual influences, for example the introduction of institutional interest or the securing of a prospective tenant where once the development was speculative. Within, therefore, lie further elements of the rationale for various employers’ requirements in construction contracts, which, for the most part, it will be largely fruitless for the contractor or professional concerned to resist.
