The Supreme Court Defines a BFOQ

BFOQ issue rejected an airline’s argument that passengers preferred their coffee and comfort ministered by women as a reason for not hiring men as flight attendants (Diaz v. Pan American 1971). Thus, employers must show that sex itself is the essence of the business, such as with a strip club. A successful defense requires evidence that customer preference for a male or female only in a job is so strong that failure to meet it would make the business fail.
