ABSTRACT
The task of understanding the components needed to form an express trust continues in this chapter with a discussion of another essential element: the benefi ciary principle and its exceptions. The benefi ciary principle is the notion that, generally speaking, an express trust must exist for the benefi t of an individual (or individuals) as opposed to a purpose or cause.
