ABSTRACT
It is a commonplace of political theory that an unlimited freedom of contract may be used to its own destruction. The individual who has the right to enter into any contract whatever may be expected in some instances to contract that freedom into the keeping of another. A Kartell consists essentially of such an alienation of contractual freedom, and the legal attitude towards it is therefore of primary concern.
