ABSTRACT

This closing chapter recapitulates the salient issues explored in this book. It outlines the significant legal and empirical insights gained. The crucial points, which are elaborated on in this chapter, are that, firstly, the rationale for prohibiting fictional child pornography (‘FCP’) is multifaceted, encompassing harm prevention and considerations of offensiveness and morality. Secondly, lawmakers should be cautioned against criminalising self-created fantasy material kept in private. Finally, this chapter concludes that, because no real child is involved in the production of FCP, there is a compelling case for creating a separate legislative provision dealing with FCP to reflect, among other things, the reduced level of criminality.
