ABSTRACT

'Art 267 The Court of Justice of the European Union (EU) shall have jurisdiction to give preliminary rulings concerning:the interpretation of the Treaties; and the validity and interpretation of acts of the institutions, bodies, offices or agencies of the Union. The Article 267 procedure allows any national court or tribunal in any of the Member States to request that the European Court of Justice (ECJ) interpret provisions of EU law. If a dispute as to the proper interpretation of a provision of EU legislation arises during a legal dispute before a court or tribunal in one of the Member States, a request made for a ruling on the interpretation of the disputed provision. The national courts, having requested a preliminary ruling, are expected to apply it to the facts of the case and give judgment. The ECJ may not rule on the validity of the Treaties. It is only secondary EU legislation that can be challenged on validity grounds.
