ABSTRACT

The EU is a unique international organisation based on a co-operative partnership between its 28 Member States. Supremacy is the key doctrines, or constitutional pillars, created by the European Court of Justice that ensure the enforceability of the legal order. supremacy' means no more than that, in areas where European Union (EU) law is relevant to a case before a national court, EU law prevails over national law. 'The Community constitutes a new legal order in international law for whose benefits the states have limited their sovereign rights, albeit within limited fields.' In Factortame the English judges recognised the supremacy of EU law and applied the clear direction given in the reference by granting the interim relief that had been applied for. Having signed the Treaty of Accession, the United Kingdom ratified its membership of the then European Commission (EC) and incorporated EC law into English law with the passing of the European Communities Act 1972.
