ABSTRACT

The main focus of the disputes between ocean powers, represented by the United States (US), and developing countries, represented by China, is whether warship of foreign states should provide prior notification to the coastal states before entering the exclusive economic zone (EEZ) of coastal states. Maritime powers believe that the principles of freedom of navigation should apply to military activities in EEZs as well as in High Seas. The maritime powers represented by the United States think that EEZs are a part of international waters, and therefore every State enjoys the right to freedom of navigation in EEZs. The coastal states enjoy sovereign rights over natural resources and jurisdiction with regard to the establishment and use of artificial island and structures, marine scientific research, protection and preservation of the marine environment, but do not have the sole authority over navigation in their EEZ.
