ABSTRACT

This chapter serves as a preliminary assessment of the efficacy of the Sino–Philippine arbitration for the South China Sea (SCS). It addresses the development of the arbitration. The chapter provides the possible reasons behind the non-compliance of China for the Merits Award. The Philippines challenged China's maritime entitlements and claims, land reclamations, enforcement and military actions and omissions within West Philippine Sea located in the eastern part of South China Sea (SCS) enclosed by the U-Shaped Line. China has breached its United Nations Convention on the Law of the Sea obligation by operating its law enforcement vessels dangerously causing serious risk of collision to Philippine vessels navigating in the vicinity of Scarborough Shoal. After three and half years the Sino-Philippine Arbitration for the SCS Disputes finally ended on July 12, 2016, with a Merits Award totally in Philippine favor.
