ABSTRACT

Part II of the Acquisition of Land Act 1981 sets out the procedure for making an order for purchases by a local authority (a procedure usually applicable to other acquiring authorities) and Schedule 1 to the 1981 Act sets out the procedure when a purchase is to be made by a minister of a government department. The procedure to be followed by local or other acquiring authorities will be described; that used when a government department is seeking an order is very similar. A compulsory purchase order must be in a form currently prescribed by the Compulsory Purchase of Land (Forms) (Ministers) Regulations 2004. The 1981 Act must be read as amended by the Planning and Compulsory Purchase Act 2004 in respect of all CPOs of which notice is given after 31 October 2004.
