ABSTRACT

Any owner of land (and where [b] below applies any person with an interest in the affected land) may serve a purchase notice on the district council or London borough council requiring them to purchase his interest in the land where:

(a) planning permission has been refused, or granted subject to conditions; or (b) a planning permission is revoked or modified; or (c) a discontinuance order has been made under section 102 of the 1990 Act; and (d) the land has become incapable of reasonable beneficial use in its existing state (or if

planning permission was granted subject to conditions, the land cannot be rendered capable of reasonable beneficial use because of these conditions); and

(e) the land cannot be rendered capable of reasonable beneficial use by making use of any existing planning permission or any permission which the local authority or Secretary of State has undertaken to grant.
