Our investigation of the organisation of the Roman empire and the history of a number of the provinces has already shown how much discretion Roman magistrates had de facto under the Republic. From the constitutional point of view, it was as a governor or military commander abroad that a magistrate was most easily able to exercise that unfettered power which, theorists have argued, was the essence of imperium. 1 What restraints were brought to bear on this power?
