ABSTRACT

In 2010, Congress passed and President Obama signed into law the Patient Protection and Affordable Care Act (ACA) of 2010 (Pub. L. No. 111-148), as amended by the Health Care and Education Reconciliation Act of 2010 (Pub L. No. 111-152). This act’s primary nursing home (NH) provisions were originally parts of bills introduced previously in multiple sessions of Congress that languished and died in committees or subcommittees, never garnering sufficient attention or support to pass on their own. However, when folded into the ACA, they were resuscitated-at least in terms of becoming law. How these provisions will fare in terms of funding and implementation in the current political and fiscal climates remains to be seen.
