Wrongful death actions are normally provided for under every state's laws, and wrongful death statutes normally provide for a wide variety of damages for the family or estate of the deceased, including loss of consortium, funeral expenses, mental suffering, pain and suffering, property damages, attorney fees, and punitive damages. Prudent professionals should also be aware of the "sympathy factor" when defending a wrongful death action. Due to the type of action, the jury will be sympathetic to the family because of their loss.
