ABSTRACT
Costa, a lawyer, owned shares in a pre-privatised Italian electric company and argued that the law privatising the industry was unlawful as it contravened EC law on monopolies. The Italian Government, after a judgment by the Italian constitutional court, argued that the proceedings themselves were unlawful since the Italian court should have followed the Italian law nationalising the electric industry which came after that ratifying the Treaty.
