ABSTRACT

The local authority sought to remove a child from an unsuitable children’s home to a residential school many miles from the mother. The mother was not present at all the meetings concerning the implementation and revision of the care plan, and was not informed of all decisions taken. In particular, she was not told of a decision not to assess her with a view to returning the child to her care. The mother sought a review of the decisions of the local authority under ss 6 and 7 of the Human Rights Act 1998 and Art 8 of the European Convention on the Protection of Human Rights and Fundamental Freedoms 1950 on her own behalf, and on behalf of the child.
