ABSTRACT
The claimant claimed to suffer shock and gastroenteritis after drinking ginger beer from an opaque bottle out of which a decomposing snail had fallen when the dregs were poured. A friend had bought her the drink and so the claimant could not sue in contract. She was owed a duty of care by the manufacturer despite the fact that she had no contractual relationship.
