The Disclosure of Evidence and Protection from Disclosure: Privilege and Public Interest Immunity

Section 23(1) of the CPIA provided for the Secretary of State to create a code of practice to accompany the Act, which included the requirement that all investigating police offi - cers record and retain any information and material gathered or generated during the investigation of a criminal offence – this included crime reports, notebooks, custody records, interview records, communications and records that derived from tapes or messages. The requirement was for this information and material to be retained at least until a decision whether or not to institute proceedings had been made against the accused.
