ABSTRACT

What is clear from this provision is that the statement must be made by a person. The result of this is that the term ‘statement’ does not cover anything that is produced by mechanical process, i.e. audio or video recordings, or photographs. The rationale for this centres on the fact that such evidence is not classifi ed as hearsay evidence and is admissible via other routes. This notion statutorily approves Taylor v Chief Constable of Cheshire [1987] 1 All ER 225.
