Hearsay: Civil Cases
Hearsay statements in civil proceedings are not the same as those in criminal proceedings. Statements in this instance include any representation of fact or opinion, regardless of how it is made (s 13 CEA 1995). The deﬁ nition of hearsay is outlined in s 1(2)(a) of the CEA 1995 as ‘a statement made otherwise than by a person whilst giving oral evidence in the proceedings which is tendered as evidence of the matters stated therein’. The CEA 1995 applies to all types of hearsay evidence (s 1(2)(b)).
