ABSTRACT
No formalities are required for the creation of a licence. The licence does not constitute an interest in land so it is outside the ambit of s 53(1)(b). This contrasts with the creation of express rights in land which must be evidenced in writing. So a licence can arise from a written document as well as from an oral grant. It can even arise by implication.
