ABSTRACT
The defendants entered into a covenant with a number of owners of land including the claimant’s predecessor in title Mrs Smith, agreeing to carry out works to limit the threat of flooding by improving and maintaining the river bank. The claimants wanted to enforce the covenant against the defendants. This depended on whether the benefit of the covenant had passed to them.
