ABSTRACT

The issue of state responsibility is one of great importance and diversity. This was one of the first topics adopted by the International Law Commission (ILC) at its first session in 1949. The complexity of the matter however is illustrated by the fact that it was not until 2001 that the Commission was able to adopt the Draft Articles on Responsibility of States for Internationally Wrongful Acts.1 Even today, those articles have not been adopted in treaty form though it is generally accepted that they represent customary international law.
