ABSTRACT

This study aims to explore the current state of legislative approximation and application of EU law in Moldova under the Partnership and Cooperation Agreement (PCA) and other EUMoldova sectoral agreements, as well as to identify the perspectives and potential problems of implementation of the future EUMoldova Association Agreement. It also discusses the legal status of the PCA and EU law within the national constitutional framework. The chapter deals with the legal foundations and institutional and methodological frameworks of legislative approximation in Moldova. It also presents an overview of the practical results of approximation of Moldovan legislation to the EU acquis. The chapter also analyses the application of EU law by the Moldovan Constitutional Court and courts of general jurisdiction. It also looks at the impact of the EU external policies towards Moldova on the application of EU law by the national judiciary.
