ABSTRACT

Under article 33 of the Slovenian Penal Code, ‘the liability of a legal person for criminal offences which the perpetrator commits in its name, on its behalf or in its favour shall be provided for by statute’. This is not stricto sensu criminal liability, as legal persons are not considered to meet the principle of subjective guilt. It is rather liability for criminal acts. But the general part of the Penal Code and the Code of Criminal Procedure do apply to legal persons.1
