ABSTRACT
To answer questions on this topic, it is necessary to have a good grasp of the common law rules, the provisions of the Unfair Contract Terms Act 1977 (UCTA) and the Unfair Terms in Consumer Contracts Regulations 1999 (UTCCR). Although the interrelation of common law and statute causes some complications, the rules themselves are relatively well established and clear. Provided that a systematic approach is adopted, then writing a good answer should not prove too difficult.
