ABSTRACT

Lawyers have traditionally called this area of law sale of goods, although for much of the high street or mail order selling which publishers do, consumer law is now a more helpful label. Even when the publication concerned is not ‘sold’ as such, but distributed free of charge (for example, a controlled-circulation newspaper paid for by advertising revenue) many of the same legal principles apply. We shall take a look at these basic principles in this chapter, and in the next chapter we will examine the special rules applying to advertising.
