ABSTRACT
Given their institutional status and professional culture, perhaps it is not too
surprising that engineers and judges speak of the sidewalk in broadly dispassionate,
functional terms. Engineers, as noted, are often uncomfortable with rights-talk,
being much happier to stay in the realm of LOS, specifi cations and the ped.
