ABSTRACT

Also known as the “blackmail settlement clause” the hammer clause is part of most professional liability policies and states that the insurance company must seek the approval of the insured prior to settling a claim. The purpose is to allow the insured to consider his or her reputation in relationship to the claim. If, however, the insured does not accept the insurer’s recommended settlement amount, the insurance company may not be responsible for damages or defense costs above that amount.
