BURDEN OF PROOF The ‘burden of proof ’ is the obligation which rests on a party to prove a particular fact in a civil or criminal case and which must be ‘discharged’ or ‘satisfied’ if that party is to win on the issue in question. This burden is often referred to as the ‘legal’ or ‘persuasive’ burden, but must be distinguished from the evidential burden.
