ABSTRACT

This chapter will explain that generally speaking only the parties to a contract can be bound by it or derive benefits from it. It is only the parties to the contract that are privy to it. This is known as privity of contract. For example, what if you buy a holiday from a travel company for you and your family and the holiday ‘goes wrong’. You can sue the travel company because you are one of the parties to the contract, but can the members of your family sue the travel company? Are they parties (privy) to the contract?
